Terms of service

All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

1. Copyright

The entire content included in this site, including but not limited to text, graphics or code is copyrighted as a collective work under the United Kingdom and other copyright laws, and is the property of Papers and Gems. The collective work includes works that are licensed to Papers and Gems. Copyright, Papers and Gems ALL RIGHTS RESERVED. Permission is granted to electronically copy and print hard copy portions of this site for the sole purpose of placing an order with Papers and Gems or purchasing Papers and Gems products. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the site solely for your own non-commercial use, or to place an order with Papers and Gems or to purchase Papers and Gems products. Any other use, including but not limited to the reproduction, distribution, display or transmission of the content of this site is strictly prohibited, unless authorized by Papers and Gems. You further agree not to change or delete any proprietary notices from materials downloaded from the site.

2. Images

Papers and Gems products are made using the finest materials. As with all materials, each item will carry small individual differences to the images provided. Due to the nature of the materials we utilize, slight variances may occur. We recommend viewing the product images with a screen resolution of 1280 x 800. Depending on your screen resolution, colour variances in products may occur. Where applicable, some hardware and fabrics may have deliberate stains or creasing as part of the overall effect of the bag. All images remain the property of Papers and Gems and may not be used without permission. 

3. Trademarks

All trademarks, service marks and trade names of Papers and Gems used in the site are trademarks or registered trademarks of Papers and Gems. 

4. Warranty Disclaimer

This site and the materials and products on this site are provided "as is" and without warranties of any kind, whether express or implied. To the fullest extent permissible pursuant to applicable law, Papers and Gems disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement. Papers and Gems does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. Papers and Gems does not make any warrantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.

5. Limitation of Liability

Papers and Gems shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Papers and Gems has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

6. Typographical Errors

In the event that a Papers and Gems product is mistakenly listed at an incorrect price, Papers and Gems reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Papers and Gems reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Papers and Gems shall issue a credit to your credit card account in the amount of the incorrect price. 

7. Order Processing

Papers and Gems aims to process your order within 24-48 hours of receiving payment and will advise you on despatch of your goods. Papers and Gems reserves the right to refuse or cancel and order at any time. 

8. Delivery 

Papers and Gems uses a range of delivery couriers and reserves the right to use an alternative if it is a more appropriate method for the delivery of your items, or where a particular delivery service is not available in your given postcode. This may impact on estimated delivery times. Papers and Gems will inform you of instances where this is the case. 

Estimated delivery timescales exclude weekends, Bank Holidays and public holidays, however this is depending on your local delivery service. 

For the safety of your goods, parcels will require a signature on receipt. If you are not available at the delivery address to accept your parcel, the carrier may return the parcel to the local depot and leave a calling card to let you know that this has been done and how to arrange a redelivery/collection of your parcel.  Parcels which are not collected from the delivery office within the courier’s recommended number of days after a failed delivery attempt will be returned to Papers and Gems. Papers and Gems reserves the right to charge a redelivery fee for a second delivery attempt. Orders shipped to non UK addresses may be subject to duties and taxes. Papers and Gems cannot be held responsible for any such charges incurred. Papers and Gems cannot be held responsible for delays incurred by the courier, for example for adverse weather conditions which may cause the carrier to incur delays.

9. Returns

Refunds

If you change your mind about an item you have received, you may return it in its full original packaging within 14 calendar days from the delivery date, provided it is unused. You must also return any free items that may have been sent to you. Failure to return any additional items will result in a reduction in the refund of your item, based on the website RRP of the free item when it was sent.

Please note gift-cards are non-returnable.

Faulty Items

Replacements for faulty items will be sent out free of charge, upon receipt and inspection of the original returned item.

How to Return

Please enclose a copy of your order confirmation email within the returns package and send the package to the address noted on your invoice.  If you are unable to locate this information, please contact us.

We recommend that a trackable delivery method is used to return the item(s) back to us. We cannot be held responsible for loss, theft or damage to items which are being returned.   Once we have received your return and it is inspected, we will send you an email to inform you that we have received your returned item, and notify you of the approval or rejection of your refund. If your return is approved, your refund will be processed and a credit will automatically be applied to your original payment method 14 working days.  Refunds can only be returned via the original payment method. We regret that we are unable to refund the original delivery fee.

A fee of 25% of the total order will be retained in instances where returned items appear used or where the full packaging is missing.

10. Promotions

From time to time Papers and Gems may offer promotions on this site. Papers and Gems reserves the right to end promotions at any time without notice.

11. Term; Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Papers and Gems without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

12. Notice

Papers and Gems may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Papers and Gems.

13. Miscellaneous

Your use of this site shall be governed in all respects by the laws of the United Kingdom, without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Papers and Gems products) shall be in the United Kingdom. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Papers and Gems products) must be commenced within one (1) year after the claim or cause of action arises. Papers and Gems's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Papers and Gems may assign its rights and duties under this Agreement to any party at any time without notice to you.

14. Use of Site

Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Papers and Gems or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.

15. Participation Disclaimer

Papers and Gems does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Papers and Gems is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, Papers and Gems reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to Papers and Gems in its sole discretion.

16. Indemnification

You agree to indemnify, defend, and hold harmless Papers and Gems, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

17. Third-Party Links

In an attempt to provide increased value to our visitors, Papers and Gems may link to sites operated by third parties. However, even if the third party is affiliated with Papers and Gems, Papers and Gems has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Papers and Gems. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Papers and Gems seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).

18. Competitions

18.1 Website

The promoter is Papers and Gems.

Competitions are open to anyone 18 years or over, except employees of Papers and Gems and their close relatives and anyone otherwise connected with the organisation or judging of the competition.

There is no entry fee and no purchase necessary to enter competitions.

By entering competitions, an entrant is indicating his/her agreement to be bound by these terms and conditions.

The route to entry for competitions is to submit the relevant form.

Any additional actions are done so at the entrant’s discretion and do not impact the outcome of the giveaway.

Only one entry per person is allowed. 

The giveaway can be stopped at any time.  

No responsibility can be accepted for entries not received for whatever reason.

The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.

The promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.

The prize will be clearly stated in the signup form.

The prize is as stated and no cash or other alternatives will be offered. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.

Winners will be chosen at random and we will share the process if anyone wants to know more.

The winner will be notified by email. Any second prizes will also be notified via email.

If the winner cannot be contacted or does not claim the prize within 7 days of notification, we reserve the right to withdraw the prize from the winner.

The promoter will notify the winner when and where the prize can be collected.

Any personal data relating to the winner or any other entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the entrant’s prior consent. You are providing your information to Papers and Gems and the web and email platform it uses and not to any other party. The information provided will be used in conjunction with the following Privacy Policy found at Papers and Gems.

18.2 Instagram

The promoter is Papers and Gems.

Competitions are open to anyone 18 years or over except employees of Papers and Gems and their close relatives and anyone otherwise connected with the organisation or judging of the competition.

We have the right to allow more than one entry per competition at times. We will notify specifically in the post if this is the case

Closing date for entry will be stated in the post on the Instagram page. After this date, then no further entries to the competition will be permitted.

No responsibility can be accepted for entries not received for whatever reason.

19. Mobile Message Service

The Papers and Gems mobile message service (the "Service") is operated by Papers and Gems and our provider Klaviyo “we”, or “us”. Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

Text messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchasing any goods or services. If you have opted in, the Service provides updates, alerts, and information (e.g., order updates, account alerts, etc), promotions, specials, and other marketing offers (e.g., cart reminders)] from Papers and Gems via text messages through your wireless provider to the mobile number you provided. Message frequency varies. Text the single keyword command STOP to any mobile message sent from us to cancel at any time. You'll receive a one-time opt-out confirmation text message. If you have subscribed to other Papers and Gems mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages. 

You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages or costs arising from your use of the Service or from you providing us with a phone number that is not your own.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
